Abstract
Human immunodeficiency virus (HIV) which causes acquired immunodeficiency
syndrome (AIDS) is the most devastating epidemics that the world faces today. It kills
millions of people each year in developing countries. The World Health Organization
(WHO), at the end of 2003, launched its 3 x 5 initiative, which among other things, aims
to provide ART to developing countries. The need for antiretroviral treatments (ART) in
developing countries greatly outweighs the current capacity to deliver this treatment. As a
result, some of those who are urgently in need of ART will not receive it initially. When
resources are limited it becomes necessary to create a policy that will outline how these
resources are to be allocated. Therefore, WHO is advocating that countries utilize fair
process and the principles of distributive justice when allocating ART. This will help
create distribution policies for ART that are seen as fair and legitimate.
