If Alternative Dispute Resolution (ADR) works quantitatively, does it work qualitatively? Is the baby being thrown out with the bath water? And, just how successful have the statistical gains been, in terms of actual cases and trials? How just has ADR been in the eyes of those involved, particularly the attorneys and the litigants? How do litigants feel when their cases are being are being legally adjudicated by someone other than a Judge? Would anyone prefer the methods of ADR a second time? In the professional eyes of attorneys, arbitrators and mediators, is justice being served?
