Abstract
The following thesis will begin by examining the "modern
courts" and how they interpreted criminal law. I will attempt to
explain why many felt that the reign of Chief Justice Warren
"handcuffed the cops." After the Warren era, the Burger and
Rehnquist Courts evolved into a much more conservative judicial
body. The criminal justice community involved with the prosecution
of the accused welcomed the Burger and Rehnquist Courts with open
arms, as power shifted from the rights of the criminal to the
criminal justice system.
The current Rehnquist Court is chopping away even more at the
rights of the accused. This will be the major focus of this thesis as
I examine the four cases of the past 1990-1991 term that struck
down five past precedents established during the Warren, Burger,
and early Renquist Court.
