Abstract
I limited the scope of my research to
the changes that had occurred in crimina1 procedure since 1953 and
focused in on one specific question: Why did the Supreme Court's
philosophy toward criminal defendants change with the retirement of
Earl Warren and the subsequent appointment of Warren Burger as Chief
Justice?
In this thesis, I will explore three areas during the course of
my research: the social and political backgrounds of the justices
serving on the Court since 1953, criminal procedure cases that have
been decided by the Warren and Burger Courts, end the domestic situation
in the U.S. at the time these opinions were being made.
