First Amendment Protections of the News Media in Conflict with Reputational Interests: A Description of Supreme Court Decisions Since 1964

The body of this paper will be divided into five parts. Part one represents a summary of defamation law prior to 1964 and the New York Times decision. Part two describes the New York Times decision in detail and elaborates on subsequent cases which followed the Times ruling. Part three is an analysis of the Court's ruling in Rosenbloom v. Hetromedia, 402 US 29, 91 S.Ct. 1811 (1971). The ramifications of the Court's holding Gertz v. Robert Welch, 418 US 323, 94 S.Ct. 2997 (1974), are detailed in section four. A conclusion is presented in part five.
